By engaging the services of Val Westover Photography, you grant Capturing True Emotion, LLC, its subsidiaries and assigns, the right to use your picture, photograph, likeness, biographical details, testimonials, and /or recording in any and all forms of media or format, and in all manners including but not limited to, online or offline, composite or edited forms, for “CAPTURING TRUE EMOTION” use, now and hereafter without further compensation, permission or notification. You waive the right to inspect, receive compensation from or approve the finished version(s) of such images including written copy that may be created in connection therewith. “CAPTURING TRUE EMOTION” and Val Westover Photography own all rights of and to any audio, video, photographs, and/or other captured and produced media. You hereby grant “CAPTURING TRUE EMOTION” (including Val Westover Photography and Stephanie Adriana Photography) the right to use your picture, photograph, likeness, biographical details, testimonials, and /or recording in any and all forms of media or format, and in all manners including but not limited to, online or offline, composite or edited forms, for “CAPTURING TRUE EMOTION” use, now and hereafter without further compensation, permission or notification. You waive the right to inspect, receive compensation from or approve the finished version(s) of such images including written copy that may be created in connection therewith. “CAPTURING TRUE EMOTION” owns all rights of any audio, video and/or photographs. You agree to take full responsibility for your own actions, safety and welfare at all times during a photo session. You agree that you and/or you and your group will conduct yourself/s in a manner that will not endanger the group or yourself. You understand that you may be removed from this event, at your own expense, prior to or during the event if you are unable to fulfill this agreement or cannot complete this photo session for health reasons. Therefore, each registrant knowingly and voluntarily WAIVES, RELEASES, SAVES, HOLDS HARMLESS and INDEMNIFIES Capturing True Emotion, LLC., a California Limited Liability Corporation, its agents, servants, employees, shareholders, officers, directors, attorneys, contractors and sub-contractors, past, present, and future, and their respective heirs, legal and personal representatives, successors and assigns (collectively, “Released Parties”), and all of their respective properties, assets and interest (“Related Property”) from, any and all claims, actions, causes of action, demands, rights, damages, costs, losses, liabilities, expenses, compensation, controversies, disputes, obligations, debts, dues and liens whatsoever, on account of, or in any way arising out of, any and all known and unknown, foreseen or unforeseen loss of life or personal injury, loss or damage to property, and the consequences thereof, directly or indirectly resulting from, incident to, in connection with, or arising out of that participants participating in the tour(s) (collectively, “Claims”). IT IS MY INTENTION THAT THIS RELEASE AND INDEMNITY AGREEMENT SHALL APPLY TO ALL OF THE CLAIMS WITHOUT LIMIT AND, TO THE FULLEST EXTENT ALLOWED BY LAW, REGARDLESS OF WHETHER FOUNDED, IN WHOLE OR IN PART, ON ANY NEGLIGENT ACT OR OMISSION OF ANY OF THE RELEASED PARTIES, REGARDLESS OF THE DEGREE OF NEGLIGENCE.
